car accident questions

me and my daughter were in an accident tonight. a guy rear-ended me. i called the cops and he told the cops he wasnt driving, the guy who was driving took off running (which i think is BS bcuz it was his wifes car) anyways i have to wait for the accident report for about another 2 wks atleast bcuz they are giving him 10 days to come up with this "guy who was driving the car"...anyways, i have never been in an accident before....i really think this guy didnt have ins because he didnt wanna call the cops. if he doesnt have ins do i have to sue them and take them to court? will i ever get my money from them if they dont have ins?

Actually your insurance will cover it, if he didn't have ins. and then your company will go after him and sue him. If they win you will get your detuctable back....Good Luck and glad your okay!

I'm not really sure. You may be able to sue the owner of the car if they cant find the guy who was driving. Good luck.

i actually just got my car not even a month ago and the ins hasnt kicked in yet i dont think

You guys doing ok?

I'm not sure how it all works with his insurance, but he is responsible since it's a rear ending accident. My friend got rear-ended by a semi, it pushed her car into an intersection, thank god it wasn't a busy road. The police that came out told her that if she hadn't been in a BMW and had been in an american made car the entire back of her car would have been crunched into her kids, I was amazed at how the BMW didn't even look like anyone had hit her... Anyway, they went to the ER but were ok other than incredibly sore. Yay for steel cars. heh.

So did you guys get checked out and stuff?

I don't know what kind of coverage you have, but ours kicks into whatever we are driving, a borrowed car, a new one, a rental car, or a test drive. I'd call your ins. if they guy doesn't have it, chances are you will spend more money trying to sue him than you'll actually ever see! It could take YEARS and you may never see anything

in our state you have to have insurance on a car before it even leaves the lot (we just learned that one the hard way lol) i would talk to whoever you have insurance with (even if you do not have it on that specific car yet) and see what they say, that is what i did when a lady hit me and they were a huge help and took care of pretty much everything for me

im really sore. my daughter seems to be doing okay. he had a saab actually and his car was worse then my buick regal. i went in after the accident cuz at the time i wasnt hurting. i had both of us checked out yeap! time to go car seat shopping now too!!!

in wisconsin you dont have to have ins, but if u dont....then ur in trouble....i think i just have liability too, thats what i had on my last car...so itd just cover for the other person if it was my fault
