
Ashley St. Clair’s legal filing against Elon Musk is not about money, she asserts. Instead, it’s about his inability to be a responsible father. Ashley, 26, is seeking sole custody of the child she welcomed in September 2024. She has said that Elon Musk, 53, is the baby’s father. She has also filed a paternity petition. In a recent statement, a representative for Ashley shared more information about Ashley’s reasons for taking legal action.

Ashley is seeking sole custody because Elon ‘can’t be counted on.’
In a statement shared with People, a representative for Ashley said she has taken legal action to protect her child. “This has never been about money for Ashley,” the representative said. “This is about protecting the best interests of Ashley and Elon’s child from a man who can’t be counted on to even communicate, much less act consistently in the role of a father.”
Though the child is now about 5 months old, Elon has allegedly only met him three times.

In the legal filing, Ashley alleged that Elon was invited to meet his alleged child when he was born, but he chose to not be there for the child’s birth. After Ashley welcomed her baby, Elon allegedly met him on just three occasions, the last of which was nearly three months ago. During that meetup, Elon only spent about 30 minutes with his alleged baby.

Ashley wanted to deal with the situation privately before taking legal action.
Previously, her representative told People that Ashley “has made every effort to collaborate with Mr. Musk before taking this step.” In the recent statement, Ashley’s rep said handling the situation privately “takes both a father and a mother” and Elon “refused all conversations.” Additionally, the representative pointed to how “Mr. Musk spends more time on his own social media platform talking about his children’s mothers than talking to them.”
Elon has not expressed interested in having custody anyway.
According to the legal documents, Ashley is the only parent who cares for the child. Elon hasn’t even initiated any conversations about his alleged baby, she claimed. “Respondent has never asked to see our child on any other occasion, he has never communicated to me about our child without my prompting, he has never asked for photos of our child or checked in after doctor’s appointments,” Ashley alleged, per the filing.
If the baby is indeed Elon’s child, he would be the billionaire’s 13th kid. However, this is not the first time Elon has been called out for seeming uninterested in being a father to his children.
Most recently, Grimes begged Elon Musk to respond to her during their child’s medical crisis.
Elon shares three of his children with his ex Grimes. On more than one occasion, Grimes and her mother have tried to reach out to Elon via his social media platform, X, alleging that they had tried connecting with him privately, but to no avail. On Thursday, February 20, Grimes took to X to try to get Elon’s attention during an “urgent” health situation involving one of their kids.
“Plz respond about our child’s medical crisis. I am sorry to do this publicly, but it is no longer acceptable to ignore this situation,” Grimes wrote at the time. “This requires immediate attention. If you don’t want to talk to me can you please designate or hire someone who can so that we can move forward solving this. This is urgent, Elon.”
