Brittany filed for divorce on Tuesday.
In the court documents, Brittany stated the reason for their divorce was "irreconcilable differences," and listed the date of her separation from Jax as January 26, 2024. She also requested that neither of them receive spousal support.
The news came after Jax and Brittany's separation was made public in February, though at the time, Jax told Page Six that their split was "not a divorce."
Brittany is asking for full custody of Cruz.
According to court documents obtained by People, Brittany is requesting to have primary custody of Cruz and asks that Jax be granted visitation.
Before Jax entered inpatient treatment at a mental health facility earlier this summer, he shared a photo of himself with his son on Instagram, writing, "Working on getting better for you and myself buddy, I love you."
The divorce filing was reportedly 'a long time coming.'
A source close to the situation told People that the filing is "something Brittany knew she had to do for the best interest of herself and her son so that they can "move forward and put a stop to this tumultuous cycle they’ve been living in."

She's no longer able to 'look past' the issues in their relationship.
Even if fans think they know the full story, it sounds like a lot has been going wrong behind closed doors.
"There’s a lot that has transpired over the past few months that she could not look past," the source said. "This decision wasn’t made lightly but she feels adamant that it was the right one."
Meanwhile, Jax is having 'mixed emotions' about the divorce.
The source told People that Jax "knows this is ultimately the right decision but is sad that things ended up the way they have."
"It’s been an emotional month for him and he’s trying to stay strong for his son," the insider added.
There's no doubt this is a difficult time for Jax, Brittany, and their family.
