Ohio Dad Said 4-Month-Old Daughter Was ‘Going To Be a Dead Baby’ — He Is Now Being Charged With Her Murder

A father in Ohio is facing the possibility of life in prison after he allegedly killed his infant daughter. Marcellaus Malone recently appeared in court, where he was indicted on multiple charges. Sadly, his infant daughter was found unresponsive, and despite efforts to save her life, she was declared dead. In the months after her death, a case was mounted against the father, and a whole slate of horrific behaviors was uncovered. He allegedly inflicted a pattern of abuse on the baby that will break your heart. Her death was the result of months of abuse, which is particularly devastating considering she was only months old. 

There was nothing that could be done to save her.

Officers from the Milford Township Police Department got a call about an unresponsive infant at Malone’s apartment on December 11, 2025, Law & Crime reported. 

According to the indictment records, when they got to the apartment, emergency medical personnel tried life-saving measures but couldn’t revive the 4-month-old. She was taken to a hospital where she was declared dead.

“The infant’s autopsy revealed no other reason for her death, but documented as a contributory cause of death, a ‘[r]eported history of occlusion of the nose and mouth by swaddling of the body and head,’” the document read, per Law & Crime.

WKRC shared some of the 911 call made by the girl’s mother after the infant was found not breathing.

“911, what’s the address of your emergency?” said 911 dispatch.

“My four-month-old is not breathing,” the caller replied.

“Okay. Is male or female?” said 911 dispatch.

“Female,” said the caller.

“Okay. Is someone doing CPR?” said 911 dispatch.

“Uh, yes. I was doing it, and now her dad’s doing it,” the caller replied.

“(Slapping) Come on, baby,” Malone said.

“Is she trying to come to, or cough, or cry, or anything?” said 911 dispatch.

“No. No,” replied the caller.

“Come on, baby,” said Malone.

It seems that the baby’s early death was inevitable.

Her death was the inevitable end to a pattern of abuse that had been going on for months, prosecutors argued when Malone appeared in court on April 22, 2026.

“Investigators discovered a video of Malone making threats to the baby,” Clermont County Assistant Prosecutor Nick Horton said. “Telling her that she was going to be a dead baby and that he was going to toss her on the bed if she p—ed him off.”

According to the prosecution, Malone would swaddle the baby in a way that also covered her nose and mouth. He’d go even further, covering her head and swaddling her tightly to the point where she couldn’t breathe and would pass out, per WKRC.

Horton shared that “on at least one occasion, he punched the infant in the face for crying, causing a significant bruising.”

She was allegedly ‘particularly fussy’ the night of her death.

Malone “was the last person” to see his daughter alive when he put her in her bassinet after her mother properly swaddled her.

A neighbor told WKRC he could hear Malone verbally abusing the baby in the past. “That dad is getting on that baby all the time, saying, ‘You cry again, I wrap you up and beat on you, and you’re not stopping crying; I’m going to fling you into the wall,’” the neighbor explained.

After Malone’s hearing, Prosecutor Mark Tekulve spoke out, reflecting on the difficult case.

“Who was abused by her own father, the person naturally who was supposed to be her protector and caregiver? And his conduct was callous beyond words,” he said.

Malone could spend the rest of his life in prison.

The 30-year-old was indicted on charges of murder, involuntary manslaughter, domestic violence, and seven counts of endangering children, WXIX reported.

On April 22, he pleaded not guilty and his bond was set at $3 million. Records show he’s due back in court on May 6.

According to WKRC, the girl’s mother has not been charged and wasn’t in court on April 22. She’s pregnant again, the prosecution said.
