Bam made the threats in a since-deleted social media post.
TMZ captured the video before it was taken down and shared a clip with readers. In the short post, Bam is going off about how he hasn't been able to see his son because of his soon-to-be ex-wife, Nicole, and threatens to go down to the boardwalk to "smoke crack until I'm dead" unless Nicole or someone else delivers the boy to him.
The angry father says he hasn't seen his kid since the end of March.
Nicole filed new legal paperwork at the end of May seeking "sole physical and legal custody" of the pair's son.
TMZ claims she is willing to allow Bam visitation after he completes a stay in rehab for his drug and alcohol abuse. Even then, she worried mom says she only wants Bam to have supervised visits with their son.
Bam says the stress has driven him to drink.
The former MTV star has accused his ex and his parents, April and Phil Margera, of "driving him to drink."
"I haven’t seen Phoenix in two f—ing months," he continued in Thursday's video.
"I have to wake up every day, knowing that I probably won’t get to talk to him or see him."
She's also asking the courts for financial support.
Nicole's lawyers are also petitioning for $15,000 a month in child support as well as spousal support for the 10 years the pair were married.
Now, Nicole's lawyer, David Glass, is speaking out about Bam's video, expressing concern about his recent claims and what he needs to do in order to get a chance to spend some time with Phoenix in the future.

Her lawyer told TMZ that nobody is making Bam drink but himself.
"Unfortunately, that's not how the addictions work," David said in a statement to TMZ. "People's behavior does not drive others to drink. This is a typical defense mechanism, and it shows that Bam may not have learned much in his past addiction's treatment. You have to take responsibility for your own actions. Nikki sincerely hopes that Bam can first achieve and then maintain sobriety, for his own good, and for the good of their son."
We hope so too. We're pulling for you Bam!
