Pennsylvania 11-Year-Old Who Allegedly Shot Sleeping Dad Following Argument About Nintendo Switch Wants To Be Tried as Kid

When Clayton Dietz allegedly shot and killed his father, Douglas Dietz, as the older man slept, he likely had no idea the magnitude of that decision. Clayton Dietz had turned 11 just a day before and looked forward to playing on his Nintendo Switch. For some reason, his father reportedly took it away, which caused the child to go into a rage. He allegedly shot his father around 3:30 a.m. on January 13, 2026. Even though Clayton Dietz is a child, he committed a very adult crime. Now his attorney wants his case tried in a juvenile court, which many don’t believe is fair.

The defense believes Clayton Dietz needs a psychiatric evaluation.

Shooting your parent because you are angry at them is definitely atypical behavior. Clayton Dietz allegedly killed his father inside their Duncannon, Pennsylvania, home. State law requires children who commit murder to be treated as adults, but an attorney can request a move to a juvenile court, per Penn Live.

According to court documents obtained by Penn Live, Clayton Dietz’s attorney, David Wilson, said his client will receive an evaluation from mental health expert Frank Dattilio. Wilson described Dattilio as “an expert on the factors that a court evaluates when deciding whether to send a case to juvenile court from adult court.”

If the case moves to juvenile court, things change for Clayton Dietz.

If a judge agrees to move the murder case to juvenile court, Clayton Dietz’s criminal record will be sealed from the public, per Penn Live. In addition, he’s likely to focus his time on rehabilitating and not be behind bars.

Perry County District Attorney Clay Merris does not agree with this decision. “Given the calculated nature of the act and other factors we intend to present at the hearing, the commonwealth intends on opposing decertification,” Merris said.

The tween currently resides at the Central Counties Youth Center in Centre County, Pennsylvania. At just 11, Clayton Dietz is one of the youngest people in state history to ever face murder charges.

For now, Jillian Dietz is trying to live a normal life.

Grieving the loss of a spouse while trying to understand how your child could have killed them is an unbearable tragedy. Jillian Dietz recently changed her Facebook profile picture, and many commented on her new look.

“Beautiful good to see your beautiful self. Love ya girl hope you are doing as well as you possibly can,” someone wrote in the comments.

“You have been through so much but I know God is with you always. You take care of you and the rest is in Gods hands,” another person added.

Jililan Dietz graciously accepted the compliments and prayers. “Thank you guys, you sure know how to help cheer a girl up. Im working on self care and the best way I can honor my husband is by taking care of me and be the best version of myself I can be,” she shared in a comment.

Is 11 too young to go to prison? It’s certainly old enough to know better. This is such a hard case and one we’re glad we don’t have to face.
