Texas Family Alleges Toddler Was Viciously Bitten at Least 8 Times at Day Care

After a toddler was picked up from his day care in San Antonio, Texas, his father noticed strange marks on his arm that appeared to be bites. The father later noticed similar marks all over the boy’s back. When the initial bite marks on the arm were pointed out to an employee at the facility, the worker remarked that they didn’t know where the marks came from. The worker also said no incident report was filled out because one can only be filled out by the child’s teacher who had left earlier that day, according to KENS 5.

Victoria Delgado and Francisco Rivas, the boy’s parents, said this isn’t the first incident they have had at the day care, and they reached out to KENS 5 to talk about the incident.

The marks on the boy's arms were very visible.

The boy’s father pointed out the bite marks on Noah’s arm to an employee at Eman Tot Academy, when he picked him up around 4 p.m. March 1, according to KENS 5. Noah was wearing a short-sleeve shirt that day, so the marks on his arm were very apparent.

“The bites were very, very visible. They were red, puffy," the boy's mother told KEN 5. "His dad questioned, 'Are those bites?' And the lady that brought him out was like, 'Oh my God, those are bites.”

The school director apologized and said she didn't know what happened.

When Noah’s parents asked about an incident report, they were told that none had been filled out and only the child’s teacher could could do so. She had left earlier in the day.

"Them changing him, feeding him, they didn't see those visible bites all day?" the boy's father asked. "They didn't call us and ask, 'Hey did your son have bites?'”

Delgado said she called the school’s director that same day. "The director of the day care, she was apologizing. She said she didn't know what happened," she shared per KENS 5. "She said she wasn't there on the premises and that she would watch the video and try to figure out what happened.”

The bite marks were not the first questionable experience Noah and his family have had at the day care, they say.

Two weeks prior, Noah had tripped and cut his lips at home. The parents were asked to immediately fill out an incident report form the next day at the day care stating that the accident happened at home, according to KENS 5.

"As soon as we took him to the day care the following day, they made us as parents fill out incident report stating the lip [injury] didn't happen here. Now they don't know anything about incident reports, but they were real quick when they saw the lip," the boy's mother said. "So what about this incident?"

The boy's parents took additional measures after they saw the bite marks.

They took Noah to an emergency room where he was prescribed antibiotics, and Delgado said the doctor confirmed they were bite marks made by a child, according to KENS 5.

Additionally, a report was filed with the San Antonio Police Department at Children's Hospital of San Antonio, and the boy's parents reported the day care facility to CPS, according to KENS 5.

Delgado explained that she didn't want to put Noah in day care, but she had started school and the city's Child Care Services department helped her with day care because they couldn't afford it. She is trying to get an emergency day care transfer for Noah, KENS 5 reported.

The mother posted an update on social media.

Delgado shared a recent update about the situation on her Facebook page, resharing the news outlet post covering their story with the post, "Reliving the worst nightmare of my life. I can’t help but be so ANGRY, so SAD, so HURT. I’m crying all over again.

"I pray none of you parents have to go through something so horrific & traumatizing," she continued in her post. "This should NOT of happened to my son. This is absolutely UNACCEPTABLE & somebody NEEDS to be held accountable. Praying and hoping that we get the answers we deserve!"

She received support and empathy in the comments.

"Omg So sad Prayers for your family #JUSTICEFORNOAH ," one user wrote.
